Independent Trustee Appointments
An overview of the situation:
We are often asked to advise clients on how to obtain a grant of representation (grant of probate or letters of administration) and how to administer the estate of the deceased, in circumstances where there are infant beneficiaries or beneficiaries who suffer from physical or intellectual disabilities. Equally, we are asked to advise clients who reside interstate or overseas. These situations can cause difficulties in obtaining grants and in the administration. For example in cases where there are infant beneficiaries in intestate estates, the court may require surety guarantees or the appointment of independent trustees for the management of the infant’s trusts.
On occasion, our firm is asked to take on the independent trusteeship. Similar situations can arise where a legal representative of the estate intends to administer it abroad. In those cases, we are also asked to act as local agents. On occasion, we are asked to give advice to trustee clients on how best to comply with their legal obligations. We have a number of independent referral partners who are able to assist trustees with investment and tax advice. Fixed & Deferred Fees
Most people can’t afford big legal bills. You shouldn’t be worried about money when a loved one dies. In most estates we manage, fees are taken entirely from the estate once the assets become available.
The other unique approach or firm takes towards billing is that it does not provide time charged services. We only provide fixed fee quotes which never change. This avoids cost blow outs and over servicing which regrettably does occur within the legal profession.

The purpose of the meeting is to assist families to navigate the minefield of bureaucracy. If nothing more, we hope to help families understand the processes of winding up an estate from start to finish so that they are at least off on the right track.
We can assist our clients to send identification, approve quotes and cost agreements all at the press of a button. Secondly, our firm has developed long standing relationships with other professionals including but not limited to accountants, realtors, valuers, auctioneers and conveyancers.
