Binding Financial Agreements often include clauses that attempt to contract out of entitlements under the Family Provision Act 1972 (WA). Although BFAs enable parties to give up rights under the Family Court Act 1997 (WA) or the Family Law Act 1975 (Cth), the authorities suggest that they cannot be an instrument by which parties contract out of the act.
