In Western Australia, a survivorship application is an application to Landgate for the registration of a title in the name of the survivor(s) of a deceased joint tenant. Survivorship applications can only be made if the joint tenants held the property as ‘joint tenants with right of survivorship’. This means that, on the death of a joint tenant, their interest in the property automatically passes to the surviving joint tenant(s). If you are the sole surviving joint tenant, you will need to provide proof of death (e.g. a copy of the death certificate). If there are multiple surviving joint tenants, you will need to provide proof that you are all entitled to inherit the interest in the property (e.g. a copy of the will). You will also need to pay a fee for the application. For more information, please visit Landgate’s website or contact them on (08) 9273 7373.
